1. Acceptance of Agreement
By subscribing to, activating, or using any services provided by Cable Co-op, Inc.—including High-Speed Broadband Internet, Digital Cable Television, Voice over IP (VoIP), and Co-op Cellular Mobile Services (collectively, the “Services”)—you (“Subscriber”, “Member”, or “Customer”) agree to be bound by these Terms of Service (“Agreement”). If you do not agree to these terms, you may not use or activate the Services.
2. Cooperative Membership & Service Eligibility
Cable Co-op is a subscriber-owned, non-profit telecommunications cooperative.
- Membership Status: Subscribers receiving residential broadband or cable TV services within our franchised service footprint may be designated as Members of Cable Co-op, Inc., subject to the Code of Regulations and Bylaws of the Corporation.
- Account Responsibility: You must be at least 18 years of age to establish an account. You are responsible for all activity occurring under your account, including unauthorized usage by household members or guests.
3. Billing, Rates, and Payments
- Recurring Charges: Services are billed monthly in advance. Ancillary fees (such as usage charges, international calling, or mobile top-ups) are billed in arrears.
- Payment Due Dates & Late Fees: Payment is due by the date specified on your monthly invoice. Late payments are subject to a $5.00 late processing fee or 1.5% per month on unpaid balances, whichever is greater, as permitted by Ohio law.
- Auto-Pay Rate Discounts: Select promotional or standard VoIP and broadband tiers include a monthly discount for enrolling in Automatic Payments (“Auto-Pay”). If Auto-Pay is cancelled or fails due to insufficient funds, the standard (non-discounted) rate will apply.
- Non-Sufficient Funds (NSF): A $25.00 administrative charge will apply to any payment returned for non-sufficient funds or rejected credit card chargebacks.
- Service Suspension: Accounts overdue by 30 days or more are subject to immediate service suspension or disconnection. A reconnection fee of $25.00 plus full payment of the outstanding balance is required to restore service.
4. Equipment Deposits, Fees, and Maintenance
- Co-op Owned Equipment: All Customer Premises Equipment (CPE)—including optical network terminals (ONTs), cable modems, set-top boxes (DTA, HD, and HD-DVR boxes), and routers—remains the exclusive property of Cable Co-op unless explicitly purchased by the Subscriber.
- Required Deposits: Standard equipment deposits are required prior to activation:
- Digital Transport Adapter (DTA Box): $20.00 deposit | $1.17 / month
- HD Cable Box: $30.00 deposit | $4.95 / month
- HD-DVR Cable Box: $50.00 deposit | $10.95 / month
- Care & Return of Equipment: Subscribers must maintain equipment in good working order. Upon termination of service, all equipment must be returned to our office at 27 E. College Street within fourteen (14) calendar days. Unreturned, lost, or damaged equipment will result in the forfeiture of your deposit and/or an unreturned equipment charge billed at full replacement cost.
5. Broadband Internet & Fair Usage Policy
- Acceptable Use: You agree not to use Cable Co-op’s broadband network for any unlawful purpose, including copyright infringement (P2P pirating), distribution of malware, network attacks, or sending unsolicited bulk email (spam).
- Network Management: To ensure optimal performance for all cooperative members, Cable Co-op employs reasonable network management practices. Traffic is not artificially throttled based on content, application, or protocol, but critical network operations may prioritize safety and integrity during high-congestion events.
- Speeds: Advertised broadband speeds represent maximum theoretical throughput (“up to”) and may vary depending on home Wi-Fi environment, device capabilities, and external internet routing.
6. Voice over IP (VoIP) & Emergency 911 Disclosure
CRITICAL 911 LIMITATIONS: Cable Co-op VoIP telephone service relies on an active internet connection and electrical power.
- Power & Internet Outages: In the event of a commercial power failure, broadband network outage, or service suspension due to non-payment, VoIP telephone service—including 911 and E911 emergency dialing—will not function.
- E911 Location Accuracy: You must notify Cable Co-op immediately if you move your VoIP ATA adapter or equipment to a new physical address. Emergency responders are dispatched based on the registered physical address on file.
- Battery Backup Option: Uninterruptible Power Supply (UPS) battery backup units for VoIP equipment are available for purchase through Cable Co-op to provide emergency standby power.
7. Co-op Cellular (Mobile Services)
- Network Partner & Coverage: Mobile services are provided via our MVNO partner network (AT&T). Coverage maps represent general outdoor availability; indoor coverage and exact data speeds are not guaranteed.
- Plan Data Allowances: Data usage on fixed-cap or high-speed mobile plans resets on the first day of each billing cycle. Once high-speed plan caps are reached, data throughput may be reduced or require a top-up purchase depending on the selected plan tier.
- Device Compatibility: Bring Your Own Device (BYOD) phones must be unlocked by the carrier of origin and compatible with VoLTE/5G technology.
8. Property Access and Right-of-Way
Subscribers grant Cable Co-op authorized employees and agents reasonable access to the service property at all reasonable hours to install, inspect, maintain, upgrade, or remove cables, drop lines, wiring, and network equipment.
9. Limitation of Liability & Disclaimer of Warranties
- Disclaimer of Warranties: All services and equipment are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including fitness for a particular purpose or uninterrupted availability.
- Limitation of Liability: Cable Co-op, its officers, trustees, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from network outages, line cuts, equipment failures, data loss, or force majeure events (including weather, lightning strikes, or acts of God).
- Maximum Damages: Cable Co-op’s maximum aggregate financial liability to any Subscriber for any service interruption or claim shall not exceed the total service fees paid by the Subscriber during the affected billing period.
10. Modifications to Agreement
Cable Co-op reserves the right to modify these Terms of Service, rate schedules, or Acceptable Use Policies at any time. Notice of changes will be posted on our primary website (www.oberlin.net) and/or included on monthly billing statements at least thirty (30) days prior to taking effect. Continued use of the Services following notice constitutes acceptance of the modified terms.
11. Governing Law & Severability
This Agreement is governed by and construed in accordance with the laws of the State of Ohio and municipal regulations of the City of Oberlin. If any provision of this Agreement is held invalid or unenforceable, the remaining sections shall remain in full force and effect.
